‘‘§ 2252C. Misleading words or digital images on the Internet
‘‘(a) IN GENERAL.—Whoever knowingly embeds words or digital images into the source code of a website with the intent to deceive a person into viewing material constituting obscenity shall be fined under this title and imprisoned for not more than 10 years.
‘‘(b) MINORS.—Whoever knowingly embeds words or digital images into the source code of a website with the intent to deceive a minor into viewing material harmful to minors on the Internet shall be fined under this title and imprisoned for not more than 20 years.
‘‘(c) CONSTRUCTION.—For the purposes of this section, a word or digital image that clearly indicates the sexual content of the site, such as ‘sex’ or ‘porn’, is not misleading.
‘‘(d) DEFINITIONS.—As used in this section—HR 4472 EAS
‘‘(1) the terms ‘material that is harmful to minors’ and ‘sex’ have the meaning given such terms in section 2252B; and ‘‘(2) the term ‘source code’ means the combination of text and other characters comprising the content, both viewable and nonviewable, of a web page, including any website publishing language, programming language, protocol or functional content, as well as any successor languages or protocols.’’.
(b) TABLE OF SECTIONS.—The table of sections for chapter 110 of title 18, United States Code, is amended by inserting after the item relating to section 2252B the following:
‘‘2252C. Misleading words or digital images on the Internet.’’.
So, what does this bill outlaw? You can’t put prank links to Goatse anymore, because they decieve people into viewing obscenity. (Clarification: This goes for everyone, not just minors!) More importantly, you can’t link to erotic art on a website that minors might read without explicitly explaining its erotic nature. So, if I were to link to, say, the anime image database Danbooru, that would be totally illegal because I didn’t tell you what sort of pictures you might find there. Which I won’t, because if the government forces me to do something like that it is clearly infringing on my right to free speech.
By the way, “harmful to minors” is defined as something that minors would find interesting but their parents would not like them seeing. Google 2252B if you don’t believe me. Therein, quite literally, is the nanny state.

Some of these prank links can be quite malicious in intent. We tricked my friend into watching lemon party and she was so pissed off that it ruined about an hour of a sweet party. If you think thats ok to do, you are more fucked up than me.

This bill is not just about “protecting” children (I take offense to the claim that teenagers need to be protected from reality, but that’s beside the point). It outlaws linking to obscenity without explanation, no matter who you’re giving the link to.

it’s not about the children. Not everything is about the children. This is about censoring what people may post.
If you simply link a url without explaining it, someone asshat that clicks on it without understanding the risk could have you sent to jail for 10 years.
I personally don’t want to be protected this way. In protecting people from risk, the government limits what you can do.
What if the only way to enforce such as this were to employee licensed editors? Nothing could be viewed on the net until it was inspected and approved. Changes would have to go through approval again. Allowing something through would get the editor fined or jailed.
That’s where this sort of thing eventually leads.
If parents don’t want to risk their babies seeing bad things on the net, they shouldn’t allow their babies to play on the net unsupervised. The net wasn’t created to entertain 8 year olds. It was created to pass porn around college campuses.

It’s one of the only weapons against uptight people who find such things offensive, like those dumbasses who are arguing that violent games are destroying our youth. If people aren’t exposed to such things, they aren’t informed. They don’t know whether they’re actually disturbing, and they don’t know how they would react. goatse was only misleading the **first** time I clicked on it. Having seen it I suspect it constitutes scientific merit.
The troublesome part to me is the egregious jail time. As a taxpayer I will clothe and feed somebody over this? Why not just fine them? That’s revenue. Actual child abuse probably has a less harsh penalty than this.

The American Bar Association claims President Bush has violated that oath by issuing hundreds of “signing statements” to disregard selected provisions of the laws that Congress passed and he signed.
A bipartisan, 11-member panel of the ABA found that President Bush is not only disregarding laws but using such signing statements far more than any president in history. In fact, Bush has used signing statements to raise constitutional objections to more than 800 provisions in more than 100 laws. All of the presidents combined before 2001 had issued only 600.
The ABA asserts that signing statements cannot be a substitute for a presidential veto and that such an assertion of presidential power amounts to a line-item veto, which the Supreme Court already has ruled unconstitutional.
The matter will likely be resolved in court. But it stands as a metaphor for a 21st century America that is no longer secure in the claim to be a nation of laws.

FEMA bans reporters from Katrina victims

Federal officials are preventing Hurricane Katrina victims in government trailer parks from being interviewed by the media unless a FEMA agent is present at all times.
The rule is coming under heavy fire from Louisiana’s congressional delegation who are blasting the policy as absurd and outrageous.
“How in the world can you stop someone in their home from talking to whomever they want?” Rep. Bobby Jindal, R-Kenner, asked the Baton Rouge Advocate. “It’s a freedom of speech issue; it’s a freedom of association issue.”
Jindal was reacting to an incident the paper reported July 15, where a reporter and photographer were ordered off a Federal Emergency Management Agency-operated trailer park in Morgan City, La.
The journalists were invited to a trailer by resident Dekotha Devall and her family. But during the interview, the news team was ordered by a security guard to leave.
When the reporter tried giving a business card to Devall, the security guard called police, saying such an act was forbidden.
The guard also told another resident, Pansy Ardeneaux, she was not permitted to speak to reporters through a chain-link fence at the park and ordered her back to her trailer.
Upon learning of the incident, FEMA officials said media had to be escorted at all times by members of the agency.
“If a resident invites the media to the trailer, they have to be escorted by a FEMA representative who sits in on the interview,” FEMA spokeswoman Rachel Rodi told the Advocate. “That’s just policy.”
FEMA says it’s not allowing media easy access to its trailer parks in order to “protect the privacy” of those dwelling there.
Jindal calls such a policy ridiculous.
“FEMA just strikes you as a bureaucracy that’s out of control,” the congressman said. “You don’t lose your fundamental rights just because you’re living in temporary housing. It’s an outrageous pattern of behavior.”
“To try and defend the behavior and say that was FEMA policy added insult to injury,” Jindal added. “FEMA should have apologized and tried to rectify the situation.”
Other members of Congress are stunned.
“These people are not incarcerated; they’re not crooks,” said Rep. Charlie Melancon, D-Napoleonville. “There’s no reason why the press or anyone else shouldn’t be able to talk to these folks if they want to talk.”
Rep. Charles W. Boustany, R-Lafayette, noted, “This seems to be a clear case of arrogance coupled with incompetence and that’ s not a good combination. I don’t think the heavy hand of government should be telling people what they can and can’t do in that regard.”
The Society of Professional Journalists has already sent a complaint to FEMA Director David R. Paulison. It was signed by SPJ president David E. Carlson and Charles N. Davis, co-chair of the Freedom of Information Committee.
“On behalf of the Society of Professional Journalists, we are writing to express outrage at the treatment given to residents of FEMA parks in Louisiana and the journalists trying to report their stories,” the two wrote.
“We are outraged by the arrogance and contempt for public discourse on display in Louisiana, a year after FEMA’s performance in the wake of Katrina earned it widespread criticism,” the letter states. “Now FEMA is banning reporters from public property as reporters try to provide scrutiny of the agency.
“We fail to see how such journalism is anything but the very sort of newsgathering for which the First Amendment was created,” the letter says.
The message requests FEMA evaluate “the constitutionality of any policy that dictates when and how those affected by FEMA’s work may speak to the press.”
It concludes, “Receipt of FEMA aid should not mean that citizens leave their constitutional rights behind.”

Which they have been known to do. If you do a Google search for “Power Puff Girls,” for example, you shouldn’t get disguised links to Hustler in your results.

I think the main thing here is the term “Harmful to Minors”. Who are they to decide what is harmful to minors? Why is sex so bad while we encourage violence? How come in other countries (Europe, specifically) show sexually related content to children and limit violent content and magically, their children are generally more stable than US Children (IE, how many times have you seen a Dutch or French school being shot up by its kids). US requests to send two more planes carrying bombs and missiles to Israel via Britain in the next fortnight would probably be approved, The Times newspaper reported in London today.
The story follows criticism by British Foreign Secretary Margaret Beckett of reported stopovers in Scotland of US planes carrying munitions for Israel.
Britain’s Daily Telegraph newspaper said two chartered Airbus A310 cargo planes laden with GBU-28 bombs landed at Scotland’s Prestwick airport over the weekend for refuelling and a crew rest on the way to Israel.
Ms Beckett said that she had raised the report with US Secretary of State Condoleezza Rice and would issue a formal complaint to Washington if the report was found to be true.
The planes that landed at Prestwick had been designated “civilian flights” and US officials had failed to notify British authorities of their hazardous contents, The Times said.
It said that the diplomatic row was more about procedure than principle, and quoted an unnamed senior government official saying flights through Prestwick “will be allowed to continue”.
